ds8 + pre9 + kernel 2.2.16 = OOPS ???

I have tried to apply ds8 and 
on kernel 2.2.16 but it seems it doesn't work (with me at least).
As soon as the boot finishes and before doing anything else, if I simply
try to ping one PC this is what I get:

Without the the patches it is working perfectly.
